Welcome to OCDRACO ILLUSTRATION’s official 2024 Commercial terms of service. Thank you in advance for considering or ordering a commission from me! These terms apply to commercial products.

By commissioning me, you are confirming that you have read and agree to these official terms of service and conditions, and are 18+ (absolutely NO minors).

Commission themes are to be approved at my discretion. SFW & NSFW are both permitted. I reserve the right to decline/cancel a commission or ban/blacklist you, without prior indication/warning if commission themes or conversation violates my TOS.

I will treat you with respect and expect the same in return!

The views and opinions of my clients do not reflect the views and opinions of myself, the artist.

Licensing Fees, Usage Rights, and Commission Costs pertaining to the artwork will be determined at the beginning of the commission process.

A contract between the client and the artist will be produced and signed by one or both parties, which will include all licensing and usage information as well as the context of the commission.

Violation of the contract and licensing terms will result in legal action and potential financial compensation.

Artist's signature or logo will be present on the artwork unless otherwise negotiated.

The artist's signature or logo and other promotional material information will be provided with each piece.

The client may not claim the artwork or identity of the artist as their own, and must always provide artist credit and/or information when presenting the artwork when possible.

The client may not use the artwork or identity of the artist to promote hate or violence towards race, sexual orientation, age, gender, religion, or groups of people.

All usage rights are non-transferrable and cannot be resold to another party.

Thumbnail and sketch work are for presentation purposes only and are not included in the final usage rights unless negotiated.

Limited usage rights can be re-negotiated after the agreed-upon timeframe or print run.

Multiple forms of usage rights can be negotiated, such as using the intact artwork indefinitely and a portion of the artwork for a limited time.

The artist will be able to use any artwork created online or physically for portfolio or promotional pieces, at any stage, unless otherwise negotiated.

No one is permitted to create or sell Non-Fungible Tokens (NFTs) or any other form of cryptocurrency from any of my artwork or private commissions.

I will not create or sell Non-Fungible Tokens (NFTs) or any other form of cryptocurrency from any of my artwork or private commissions.

Prices are predetermined on my website and through a personalized quote before the art process begins.

Discounts will not be added after the commission price has been determined, and the commission price will not change throughout the art process.

Payment is required in full before the beginning of work.

A PayPal invoice will be sent to the client by the provided email before work begins.

Do not send an unapproved payment for a commission to me. Premature payments will be immediately refunded and an invoice will be made, and the client may be responsible for PayPal refund fees.

I use PayPal only. I do not accept checks, money orders, cash, or any other form of payment unless otherwise agreed upon.

Tips are always welcomed and appreciated, and will ensure extra care and speed, but are not required.

Pricing may change due to personal sales, demand, or emergencies. They may also change due to character/background/prop complexity, but will always be listed on my website up to date.

Payment plans are available by arrangement should the commission amount to $500+

Commissions with 6+ figures may result in extra charges.

Character complexity such as more than two wings, extra appendages, complex skin/coat patterns may result in extra charges.

I withhold the right to take as much time as needed on commissions but will never “take your money and run”. After a 6 month period without completion, 50% of the client’s money will be refunded, and the art will still be completed. After a 12 month period without completion, 100% of the client’s money will be refunded and the art will still be completed in due time. This does not apply to commissions affected by lack of client communication.

Refunds permitted will be issued through PayPal through the original transaction/invoice.

Refunds are not permitted after the commission is completed.

I, the artist, reserve the right to cancel any commission (due to illness, emergency, art block, etc.) and the client will be fully refunded. I will have rights to the image at any stage of progress, and it will be re-purposed at my discretion.

Each piece takes a different amount of time, but I strive to be quick at what I do. Your piece can take up to 3 months, or longer, but I try to clear my queue on a bi-weekly schedule. Process times WILL vary.

Rush orders are available, the price of such will be decided upon in discussion before the art process begins.

File size and resolution (300-350 dpi) will be set by me, unless a different size is requested (for an icon, banner, wallpaper etc.).

Final images will be saved as a .jpg/.png unless otherwise requested (Vector conversion may result in extra charges).

File will be sent in full resolution to an email address I request of the client or by other requested specific outlets (such as Telegram’s file system or Discord).

There will be no WIPs (unless requested) for sketch commissions/Icons/Artistic Freedom pieces, and edits are only made for major artists error & color changes for such.

Edits/changes will not be made post-production for items forgotten by the client (as all information should be listed in the commission form).

For larger, colored commissions, the client must approve of the sketch stage and address any changes before I continue, and no changes will be allowed to the base sketch afterwards. Three more changes will be allowed during the final stages.

Requested changes past the allowed three, that are not artist’s error, will result in charges (from $5-$15 in editing fees).

24-48 hrs is the suggested wait time after a commission is completed and sent to determine satisfaction before any further changes will be discussed/made.

4 weeks after a commission is completed, I will no longer accept/make changes to a finished piece. Past 6 months, I will delete the working .psd file, unless the artwork is under a limited license.

Clients are strongly encouraged to have a ref sheet prior to a character commission. Character descriptions are allowed for reference sheet commissions only.

Clients are strongly encouraged to include clear and concise information relevant to the commission for an accurate and satisfactory product. I am not responsible for missing information during the pre or post-work process.

Clients are encouraged to email, send Telegram, Twitter, or Instagram messages to my contact information provided to request a quote.

Clients are responsible for providing two-way communication, more than one outlet is preferred but not required.

I will not hunt or seek the client out online, or dig for other lines of communication not provided. The client is always responsible for making contact again to receive a refund if necessary if they have been absent for more than a month.

Forms/emails/messages are responded to with quotes within 24-48 hrs. If I am unresponsive within that time, check your spam folder or contact me through other social media. If I am unresponsive for a month or more without warning, the client should file a PayPal claim for a refund if necessary.

Commissions will be recorded/documented on Trello in their respective slots in order of their submission/acceptance until they are completed, and I am responsible for updating the queue as it changes.

I send updates semi-regularly for larger projects, guaranteed updates will be at the sketch/linework, and flat color phase. If you need further/more updates or do not wish to be updated until completion, please request this before the art process begins.

The client fails to pay an invoice within 3 days of delivery. The client will be warned then banned if they continue the habit with future commissions.

There is a lack of communication from the client for longer than two weeks. I will cancel the order and issue a refund at its current state of completion.

Communication is cut off by deleted accounts, and no other communication outlet was provided. The order will be canceled and a refund based on progress will only be issued once contact is made again via the client.

Exceptions to abandoned commissions include illness, natural disasters/severe weather, or previously negotiated terms.

Clients are expected to conduct business and conversation in a polite and professional manner.

I** do not** tolerate abusive or derogatory language, trolling, baby talk, spam, role-play, sexual advances, or idle chatter during the commission process. Continuation of such after a warning will result in termination of the commission and partial or no refund. The client will be banned from requesting a commission and my social media if this behavior persists.

Prices are non-negotiable, and haggling or asking to lower prices is inappropriate and your commission will likely be declined.

Spamming/trolling my social media pages or promoting hate or violence towards race, sexual orientation, age, gender, or religion on my social media pages will result in a ban.

Unauthorized edits or use of my artwork and gallery depicting hate speech or violence towards race, sexual orientation, age, gender, or religion will result in a ban & public awareness of the client's behavior.

Hand-delivered items are unavailable unless it is convention pick-up, or the client is a mutual.

Client is responsible for meeting me at the specified times/location, and if a no-show occurs, they are required to pay for the product to be shipped to them.

Client is responsible for providing a valid address and understanding their local customs’ fees and laws, and if they are required to pick up mail or a delivered package.

Mailing/shipping fees will be determined before the art process begins calculated from the postage, packaging, and delivery costs unless the fee is determined by weight. (US shipping preferred but international mailing is available).

Mailing/shipping can take up to 3 weeks for US, and up to 5 weeks international, unless affected by current events.

Refunds/replacements for damaged products or failed delivery will only be given with proof of damage caused by the shipping process, and shipping fees will be charged once more to the client.

Tracking numbers are provided for packages and anything larger than flat rate mail upon request. Tracking numbers will not be provided on letters.

As of 2020, insurance is not provided on packages unless the shipping service does so.

I do not accept private commissions at this time (where I do not post the finished work online) unless the client buys out the rights at 3x the commission cost. I will permit delayed posting for special events/holidays on request for free.

I retain all rights to the artwork via US copyright laws and Moral Right.

I retain full publication/printing rights, but out of respect of the client will ask before printing or using the art for any other purposes.

I reserve the right to redistribute the artwork on any website, as well as use for advertisements of my services. I will politely decline requests to remove work from my galleries unless the artwork represents the client in an outdated manner.

Clients are given the right to issue a takedown request against third parties, whose characters are not depicted in the image if the art has been stolen/misused/falsely claimed.

Clients are permitted to re-post on any platform with due credit to me, the artist. Removal of my watermark or failing to credit the work will result in a permanent ban and removal of the post. If I feel as if my Moral Right to an image has been compromised, I will issue a takedown.

Claiming the art as your own or another person’s, tracing/referencing without permission, or editing the original work (by you or another artist) without my explicit permission and clear labeling of changes will result in a permanent ban, possible legal action and I will issue a takedown if appropriate.

Resizing the image for personal use is permitted.

Commissions are for private use only.

The client is not permitted to use their private commission for monetary or commercial gain unless previously negotiated.

The client or any other persons using my art to advertise paid services, or for any other monetary gain (such as behind a paywall) will be considered an unauthorized commercial project and will be DMCA’d without notice.

I will not claim your characters/brand as my own. By commissioning me you are granting permission to draw your character/subject in the agreed-upon setting, nothing more.

Clients are permitted to use the artwork received as a reference/guide when commissioning or working with another artist (i.e. character design).
